With the continuous improvement of China's comprehensive national strength, more and more expats choose to work in China, this article will go through some situations which based on the real cases according to Emigration and Immigration Administration.
近年来,随着我国综合国力不断提升,越来越多的外籍人士选择来华工作,这篇文章,均由移民管理警察查处的外国人非法就业案件改编,举例说明几种非法工作情况,并在附上外国人如何在中国合法工作的相关信息。
NO1.Foreign Travels
案例一:外籍旅游达人
Leo, an experienced backpacker from F country who came to China for travelling, he spent all his money and then decided to find a “part time job” to ease his financial situation, so he started to work as an English teacher in an international private school. However, the immigration police found out this and matcheo got fined 5,000 RMB and the private school was fined 10,000 RMB in the end.
F国小伙Leo是旅游达人,一次持旅游签证来中国旅游过程中,偶然得知某“国际”私立学校招聘外教,便抱着“小试牛刀”的心态应聘,成功成为该学校的一名外语教师,结果被移民管理警察查获。Leo被处以五千元罚款,聘用Leo的学校也被罚款一万元。
Relevant Laws:
①According to Emigrationand Immigration Administration Law, expat who wants to work in China must have legal work permission and residence permit. No company or individuals shall employ any foreigner who has not obtained the two permits mentioned above. (Article 41)
《出境入境管理法》第四十一条
外国人在中国境内工作,应当按照规定取得工作许可和工作类居留证件。任何单位和个人不得聘用未取得工作许可和工作类居留证件的外国人。
② Expat who works in China illegally, will be fined more than 5,000 RMB but not more than 20,000RMB, for the serious case, will be detained for more than 5 days but not more than 15 days. (Article 80)
《出境入境管理法》第八十条
外国人非法就业的,处五千元以上二万元以下罚款;情节严重的,处五日以上十五日以下拘留,并处五千元以上二万元以下罚款。
NO.2 International students
案例二:国际留学生
Luke, a foreign student from J country who came to China for studying, instead of going to school and taking class, he chose to work in an English agency and he was sent to teach classes in five kindergartens with 8,000 RMB salary per month. Eventually, Luke got caught and fined 10,000 RMB and detained for 10 days, meanwhile, the company he worked for got fined 10,000 RMB and confiscate illegal incomes.
J国留学生Luke获得学习签证后并没有去学校上课,而是受聘到一家商业机构负责英语教材销售。商业机构将他派遣到5个幼儿园去上课,每月可以领8千元的工资。正当Luke做着发财的美梦时被移民管理警察查获,被处行政拘留十日并处罚款一万元,聘用他的商业机构及幼儿园均被处以罚款一万元并没收违法所得。
Relevant Laws:
①According to Emigration and Immigration Administration Law, A foreign student who violates the regulationson the management of part-time work and study aboard and is working within the territory of China beyond the prescribed post range or time limit, will beregarded as illegally working. (Article 43)
《出境入境管理法》第四十三条
外国人有下列行为之一的,属于非法就业:
(一)未按照规定取得工作许可和工作类居留证件在中国境内工作的;
(二)超出工作许可限定范围在中国境内工作的;
(三)外国留学生违反勤工助学管理规定,超出规定的岗位范围或者时限在中国境内工作的。
② Anyone or any company who illegally hires foreigners shall be charged 10,000 RMB per person for illegal employment, but the maxim fine shall not exceed 100,000 RMB; if there is illegal income, the income will be confiscated. (Article 80)
《出境入境管理法》第八十条
非法聘用外国人的,处每非法聘用一人一万元,总额不超过十万元的罚款;有违法所得的,没收违法所得。
NO.3 Work Visa with Certian Limitations
案例三:超出工作许可限定范围
10 foreign actors from W country obtained the short-term work visa to perform a show at Y city, S province. To increase the income, the leader decided to add one more show at N city, S province, so he contacted a local agency to help him to arrange the place. However, after the show, the relevant authority found out it and the teamand the agency were fined 50,000 RMB separately.
某W国表演团体10名外籍演员到S省进行舞蹈演出,经申请依法获得省文化厅的表演批复和外国人短期工作证明,但演出许可范围仅限Y市。为了增加收入,团体领队私自联系中介增加了同省N市的一场演出,却在演出时被移民管理警察发现,该演出团体及中介各被处以五万元罚款并没收违法所得。
Relevant Laws:
①According to Emigrationand Immigration Administration Law, foreigners shall not engage with otherworks that beyond their work permission. (Article 43)
《出境入境管理法》第四十三条
外国人有下列行为之一的,属于非法就业:
(一)未按照规定取得工作许可和工作类居留证件在中国境内工作的;
(二)超出工作许可限定范围在中国境内工作的;
(三)外国留学生违反勤工助学管理规定,超出规定的岗位范围或者时限在中国境内工作的。
② Introducing foreign nations to work in China illegally, each individual will be fined between 5,000 to 50,000 RMB, each company will be fined between 5,000 to 100,000 RMB, and the income will be confiscated. (Article 80)
《出境入境管理法》第八十条
介绍外国人非法就业的,对个人处每非法介绍一人五千元,总额不超过五万元的罚款;对单位处每非法介绍一人五千元,总额不超过十万元的罚款;有违法所得的,没收违法所得。
NO.4 Part time Jobs
案例四:投机取巧的兼职工作
Peter is an international student from L country, he found an online part time job and got paid 6,000 RMB per month. Even though he took class regularly, he was required to submit all the income and to leave China within a certain period after the Immigration Administration found out his action. However, Peter didn’t leave China as he was required to, and he re-started his online part time job and got caught again, eventually, he was detained for 15 days, and deported and not allowed to enter China within 3 years.
Peter是一名L国留学生,学习期间,他通过网络找到了一份兼职工作,拿着每月6千多元的工资,小日子过得美滋滋。然而“好景不长”,很快就被移民管理警察发现,被处以罚款并处限期出境。被处罚后Peter心有不甘,并未按要求在规定时间出境,而是悄悄“重操旧业”,一个月内再次被查获,行政拘留15日后被遣送出境,三年内不准入境。
Relevant Laws:
① According to Emigrationand Immigration Administration Law, foreigners who illegally staying or working in China will be deported, the person shall not enter China in 1 to 5 years, starts from the date of deportation. (Article 62)
《出境入境管理法》第六十二条
外国人有下列情形之一的,可以遣送出境:
(一)被处限期出境,未在规定期限内离境的;
(二)有不准入境情形的;
(三)非法居留、非法就业的;
(四)违反本法或者其他法律、行政法规需要遣送出境的。
被遣送出境的人员,自被遣送出境之日起一至五年内不准入境。
外国人因各种不同的原因选择在中国工作,非法工作看起来是一件小事,但是一旦被抓,就会惹得一身麻烦。所以,现在中国有关当局也越来越重视,并且现在外国人工作签证的申请比以前更加复杂和严格,因此,我们也应该对此多加了解。
《中华人民共和国出境入境管理法》第四十一条规定:
外国人在中国境内工作,应当按照规定取得工作许可和工作类居留证件。任何单位和个人不得聘用未取得工作许可和工作类居留证件的外国人。
外国人非法就业的,处五千元以上二万元以下罚款;
情节严重的,处五日以上十五日以下拘留,
并处五千元以上二万元以下罚款。
介绍外国人非法就业的,对个人处每非法介绍一人五千元,
总额不超过五万元的罚款;
对单位处每非法介绍一人五千元,总额不超过十万元的罚款;
有违法所得的,没收违法所得。
非法聘用外国人的,处每非法聘用一人一万元,
总额不超过十万元的罚款;有违法所得的,没收违法所得。
《外国人工作许可证》是外国人在中国工作的合法证件。根据《外国人在中国就业管理规定》第八条规定,在中国就业的外国人应持职业签证入境,入境后取得《外国人就业证》和工作类居留许可,方可在中国境内就业。
